This legal notice governs access to, browsing of and use of the website https://opticapalmanova.com (hereinafter, the «website»), owned by Óptica Palmanova. Access to the website confers the status of user and implies full and unreserved acceptance of each and every provision of this legal notice in the version published at the time of access. Users are therefore advised to read its content carefully.

The optical activity is subject, among other rules, to Real Decreto 1591/2009, de 16 de octubre, por el que se regulan los productos sanitarios, as well as to the specific regulations of the optical sector, which require that the prescribing and fitting of custom-made medical devices be carried out by a registered optician-optometrist.

2. Purpose of the website

The purpose of the website is to:

  • Provide information about Óptica Palmanova, its optometry services and its physical establishment in Calvià.
  • Enable the online purchase of sunglasses, contact lenses, maintenance solutions and optical accessories.
  • Facilitate the booking of an in-person appointment for the services that, owing to their health-related nature, require professional attention in the shop.

Prescription glasses are not sold online. As this is a custom-made medical device that requires a prescription issued by a registered optician-optometrist, its prescribing, fitting and collection are carried out exclusively in person and by prior appointment at the Calvià establishment. The website does not allow the purchase of prescription glasses at a distance.

3. Conditions of use of the website

The user undertakes to make appropriate and lawful use of the website and its contents, in accordance with the legislation in force, this legal notice, morality and good customs and public order. In particular, the user undertakes to:

  • Not use the website for unlawful purposes or effects, or in a manner harmful to the rights and interests of third parties, or that may in any way damage, render unusable, overload or impair the website or prevent its normal use.

Purchases made through the website are governed by Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU) and other consumer regulations. In particular:

  • The consumer has a right of withdrawal of 14 calendar days for distance purchases (article 104 TRLGDCU), subject to the exceptions provided for by law (among others, personalised or custom-made products, art. 103.c, and items sealed for hygiene reasons once unsealed, such as opened contact lenses and solutions, art. 103.e).
  • The products carry the 3-year legal guarantee of conformity established by Ley 7/2021 for purchases made after 1 January 2022.

9. Dispute resolution and complaint forms

Óptica Palmanova has official complaint forms available to consumers at its physical establishment in Calvià.

Likewise, the consumer may turn to the Junta Arbitral de Consum and the Direcció General de Consum del Govern de les Illes Balears as out-of-court means of resolving consumer disputes. 10. Applicable law and jurisdiction

This legal notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the website, the parties submit to the legislation and to the courts and tribunals that have jurisdiction under the law.

Where the user acts as a consumer, the determination of the competent jurisdiction will be made in accordance with consumer and user protection regulations, the competent forum being, as a general rule, that corresponding to the consumer's domicile, without any forum other than that of the consumer themselves being imposed.
